Terms of Service for Sircle Yoga Dance On Demand Program Online

Welcome to Sircle Yoga Dance!

These Terms of Service (“Terms”) govern your access to and use of our website, www.sircleyogadance.com (the “Website”), and the services offered thereon (the “Services”). 

By accessing of using the Website or Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Website or Services. 

1. Overview

Sircle Yoga Dance provides an online platform for yoga, dance and meditation classes, workshops and other dance-related content (the “Content”). 

2. Acceptable Use

You agree to use the Website and Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Website or Services in any way that could damage, disable, overburden, or impair the Website or Services.
• Attempt to interfere with the proper functioning of the Website or Services.
• Use the Website or Services to create or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or racially or ethnically offensive. 
• Infringe on the intellectual property rights of others. 
• Share your account login information with any third party. 

3. Content Ownership

The Content on the Website, including all choreography, sequence of movements, text, graphics, videos, audio, and other materials, is protected by copyright and other intellectual property laws. You agree not to reproduce, distribute, modify, create derivative works of, or publicly display any Content without the express written permission of Sircle Yoga Dance. 

Practice Content shared online must be limited to less than 20 second of sequence choreography, or edited so that the exact sequence is not shared publicly. The only exception to this is 5 Elements sequence, which is publicly shared by the Website. 

4. Disclaimers and Warranties

The Website and Services are provided “as is” and without warranties of any kind, express or implied. Sircle Yoga Dance disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 

Sircle Yoga Dance does not warrant that the Website or Services will be uninterrupted, error-free, or virus-free. Though the best precautions are taken to ensure smooth operation, you understand that you use the Website and Services at your own risk. 

Sircle Yoga Dance is not responsible for any injuries or damages you sustain as a result of using the Website or Services. You agree to consult with a healthcare professional before starting any new yoga practice. You also ensure your space is free of any hazards that may impact the freedom to move freely in the space. 

5. Limitation of Liability

In no event shall Sircle Yoga Dance be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses) arising out of or relating to your use of the Website or Services, even if Sircle Yoga Dance has been advised of the possibility of such damages.
